SECTION 1 – CONTRACT AND QUOTATIONS
1.1 Contract
The agreed final quote represents a written contract for the specified work to be completed at the quoted price. Any verbal agreements must be confirmed in writing. This agreement is between PaintWaller Ltd and the client requesting the quotation.
1.2 Scope of Work
The written quote details the tasks requested by the client. PaintWaller Ltd is not liable for any tasks not included in the written quote.
1.3 Site Facilities
The client must provide reasonable access to electrical power, running water, and toilet facilities for the duration of the project.
1.4 Condition of Walls and Ceilings
Unless specified otherwise, it is assumed that the underlying plastering is in good condition. Additional repairs, if required, may incur extra charges.
1.5 Cancellation and Rescheduling
Clients must notify PaintWaller Ltd in writing at least 7 days before the project start date to cancel services without penalty. Cancellations within 7 days will incur a 15% cancellation fee of the total project cost. Once work has commenced, a cancellation fee of 50% will apply. Rescheduling is acceptable if the new date is within 8 weeks of the original start date.
SECTION 2 – PAYMENT TERMS
Payments are accepted by bank transfer or cash. Cheques are not accepted.
2.2 Deposit
A non-refundable deposit of 25% of the total project cost is required to secure your booking. This deposit will be deducted from the final payment. Deposits are refundable if cancellation occurs at least 7 days before the scheduled start date.
2.3 Final Payment
The remaining balance is due within 7 days of project completion. An £80 administrative fee will be applied to late payments. If payment is not received within this timeframe, PaintWaller Ltd reserves the right to involve a debt collection agency, adding a 33% service charge to cover associated costs.
2.4 Outstanding Balances
Unpaid accounts will be handled by a debt collection agency, and all additional fees will be added to the client’s outstanding balance.
2.5 Right to Partial Payment
The painter has a full right to request fair compensation for parts of the job that have been completed. Clients are not permitted to withhold payment as a form of guarantee or leverage. Any agreed and delivered portion of the service must be paid for promptly and in good faith.
SECTION 3 – COMPLETION AND MATERIALS
3.1 Completion Time
Estimated completion times are guidelines and while we aim to meet these, we will not be held liable for delays.
3.2 Materials and Tools
We use high-quality materials as per the manufacturer’s guidelines. PaintWaller Ltd is not responsible for the performance of materials purchased directly by the client.
SECTION 4 – DAMAGES AND WORKMANSHIP
4.1 Refund Policy
Refunds will only be considered in the following circumstances:
– Project Cancellation by PaintWaller Ltd: If we cancel the project before work has commenced, a full refund of any deposits paid will be issued.
– Client Cancellation: Refunds will only be provided as per the cancellation policy (Section 1.5). No refunds will be issued for cancellations after work has commenced.
4.2 No Refunds for Completed Work
Once a project has been completed and signed off by the client, no refunds will be issued. If there are any issues with the quality of work, clients must notify PaintWaller Ltd within 24 hours to allow us to address and resolve the issue.
4.3 Materials Purchased
Refunds for materials purchased by PaintWaller Ltd on behalf of the client will only be issued if the materials are unused and in resellable condition. A 10% restocking fee may apply for returning unused materials.
4.4 Force Majeure
Refunds will not be issued for delays or cancellations caused by events outside of PaintWaller Ltd’s control, such as extreme weather, acts of God, or unforeseen disruptions.
4.5 Damages
Clients must remove valuable or fragile items from the work area. We will take all precautions to protect the property, but we are not responsible for damage to items that were not removed.
4.6 Workmanship
If the client is dissatisfied with any part of the work, they must notify us within 24 hours of completion. Clients must allow PaintWaller Ltd to rectify any issues before engaging third-party contractors.
SECTION 5 – PRIVACY POLICY
We collect customer data to assist with inquiries and for marketing purposes. You can request for your details to be removed from our marketing list by contacting us directly. We will not sell or pass your data to third parties unless required by law.
SECTION 6 – JOB INTERFERENCE AND PRIVACY
6.1 Job Interference
Clients are asked to avoid commenting on or inspecting the work during early stages, as our team follows a detailed process to ensure quality results. Comments or feedback are encouraged only once substantial stages are completed.
6.2 Respect for Privacy
Interactions with our team should remain professional. Personal inquiries, such as those related to background, religion, or beliefs, are discouraged to maintain a respectful working environment.
SECTION 7 – DISCOUNTS AND PROMOTIONS
7.1Discounts Discounts apply to labor costs only and cannot be combined with other offers. Materials are excluded from promotional discounts. PaintWaller Ltd reserves the right to end promotions at any time.
7.2 Discount validity
Discounts are only valid for the full quotation provided and are conditional upon full payment as agreed. If a client reduces the job scope after the quote has been issued or withholds payment due to a dispute, the discount will be deemed invalid and the full standard rate will apply.
SECTION 8 – REVIEWS AND FEEDBACK
7.1 Feedback and Reviews
We value honest feedback from our clients and we use reviews to continuously improve our services. Clients are encouraged to provide constructive feedback based on their experience.
7.2 Inappropriate or Defamatory Reviews
In the case of reviews that contain inappropriate, false, or defamatory content, PaintWaller Ltd reserves the right to take the following actions:
– Contact the Reviewer: We will first attempt to resolve the issue by contacting the reviewer directly to understand the concerns and address them professionally.
– Legal Action: If a review is proven to be defamatory or damaging to our business without basis, we reserve the right to pursue legal action to protect our reputation.
– Reporting to the Platform: We reserve the right to report inappropriate or malicious reviews to the platform where the review is posted, requesting its removal if it violates the platform’s guidelines.
7.3 Resolving Issues
Clients are encouraged to contact us directly with any concerns regarding our services before leaving a review so we can address any issues in a timely and professional manner.
SECTION 9 – CLIENT ON-SITE REQUIREMENTS
9.1 Personal Protective Equipment (PPE)
If any client or their representative needs to be on-site to observe the work process or discuss details with the team during working hours, they must wear full Personal Protective Equipment (PPE). This is to ensure the safety of everyone on-site and to comply with health and safety regulations. PPE requirements will be communicated in advance if applicable.
SECTION 10 – WORKPLACE FACILITIES AND TOOLS
10.1 Client Responsibilities for Workplace Facilities
To ensure the smooth execution of the project, the client must provide the following facilities:
- Electricity: Reliable access to electrical power for the operation of tools and equipment.
- Water: Access to running water for cleaning and preparation purposes.
- Toilet Facilities: Reasonable access to restroom facilities for the team during the work period.
Failure to provide these facilities may result in delays or additional charges to cover alternative arrangements.
10.2 Tools and Equipment Usage
PaintWaller Ltd is committed to delivering high-quality finishes. To achieve the desired outcome, we may use a variety of tools and equipment, including but not limited to:
- Power tools for surface preparation and sanding.
- Paint sprayers and other advanced paint application materials for an even finish.
Clients are advised that the use of such tools may produce noise or require additional workspace. PaintWaller Ltd will take all necessary precautions to minimize disruption and ensure safety during the project.
SECTION 11 – WORKING HOURS AND SITE ACCESS
11.2 Property Access We generally accept jobs for empty or vacant properties, ensuring our decorators have full access throughout the day. This enables our team to work without interruptions and complete the job on time.
11.3 Occupied Properties
For occupied homes, we will proceed only if the client agrees to our working hours. If the client consents to work being carried out up to 8:00 PM, we will accommodate this to ensure timely completion. Please communicate any concerns prior to the job start date.
